Evictions
:Notices to Quit:
A landlord must ensure that before evicting tenants that the landlord has a notice to quit that will stand up in court. When serving a tenant with a three-day notice to pay rent or quit, a landlord must give the tenant specifics as to how the landlord may be reached in order that the tenant may pay rent during that three day period. The three-day period starts on the next day, and if the last day falls on a weekend or a court holiday, then tenants must be given until the next court day to pay their rent. Rent may not be overstated on a three-day notice to pay rent or quit. So time is not wasted, a landlord would be well advised to have any notice to quit reviewed by an attorney prior to service on the tenant. Remember, that errors in a three-day notice may cause unlawful detainer lawsuits (evictions) to be dismissed at trial, so it is important for landlords to get it right from the beginning. Given that it can take over a month get to trial when a tenant stops paying rent, it is financially crucial that landlords take all precautions to make sure that their notices to quit are flawless.
